1. Introduction & Acceptance of Terms

Welcome to Cao Xuan (operating professionally as Alan Cao / Still Moments) ("we" / "us" / "our"), an individual operating under the laws of China.

These Terms of Service & Sale ("Terms") govern your access to our website (https://www.stillmoments.art) and purchases of our digital artworks.

By purchasing a digital artwork through a Still Moments purchase link or checkout, you confirm that you:

(a) are at least 18 years of age; 

(b) have read, understood, and agree to be bound by these Terms, together with our specific License & Usage Rights and Refund Policy; and 

(c) agree to our Privacy Policy.  

2. Product Description & Creation Process

2.1 What We Provide

Still Moments sells digital artwork files for personal and commercial interior display.

2.2 Human-Led Creation Process

Our artworks are crafted through a digital mixed-media process. Each piece originates from original artistic conceptualization and inspiration by artist Alan Cao, incorporates AI-assisted rendering techniques during the design phase, and is completed through detailed manual image retouching and refinement by the artist.

2.3 Nature of the Service

Unless a product page expressly states otherwise, products sold through Still Moments are digital products only. No physical artwork, canvas, or frame is included in the purchase. Digital products are delivered electronically after successful payment.  

3. Purchases, Prices & Payment

3.1 Merchant of Record

Payments are processed through our payment processor, Waffo Pancake. Waffo Pancake acts as the merchant of record for applicable transactions and handles payment processing, billing, receipts, refunds, and applicable transaction taxes. Still Moments does not directly process or store your full payment card credentials.

3.2 Purchase Authorization

Each digital artwork purchase is a one-time transaction. By completing a purchase, you authorize Cao Xuan (via Waffo Pancake) to charge your payment method for the amount displayed at checkout.  

4. Billing Disputes

If you believe there is an error in a charge or a duplicate charge, please contact us at hello@stillmoments.art before disputing with your bank. We commit to responding within 2 business days and resolving confirmed billing errors within 5 business days.  

5. Refund Policy Summary

Due to the digital nature of our art, once your files have been emailed to you, orders are final and non-refundable. except where a refund is required by applicable law or otherwise determined to be appropriate under Waffo Pancake's applicable policies and procedures.

If you wish to cancel and request a refund before the files are delivered and emailed to you, please contact us immediately. 

5.1 Eligible Refunds  

Genuine Product Issues: If a file is corrupted or technically defective, please contact us. Where a genuine issue cannot reasonably be corrected by a replacement file, a refund may be available.  Duplicate Charge: Full refund for any billing error resulting in a duplicate charge.

6. Intellectual Property & Licensing Summary

All copyrights and other intellectual property rights in the artwork remain with Cao Xuan (Alan Cao) / Still Moments. Purchasing a digital artwork does not transfer copyright ownership.

Each purchase grants a limited, non-exclusive, non-transferable license for personal use and commercial interior decoration, covering one physical property or location. For full details on permitted uses, please review our comprehensive License & Usage Rights.  

7. Acceptable Use & Prohibited Uses

You agree NOT to use our website or purchased digital artworks to:

Resell, redistribute, share, publish, or publicly distribute the digital file.

Upload the artwork to stock-image, asset, template, or similar libraries.

Use the artwork in print-on-demand products for resale.

Incorporate the artwork into products, merchandise, packaging, or other items for resale.

Use the artwork as a trademark, logo, brand identity, or service mark.

Claim the artwork as your own original creation.

Infringe the intellectual property or privacy rights of any third party.

Violate any applicable law, regulation, or card network rule.

7.1 Consequences of Violation

If you materially breach these Terms, including by reselling, redistributing, sharing, publishing, or otherwise using a purchased digital artwork beyond the scope of the license granted under these Terms, we may, to the maximum extent permitted by law:

(a) terminate or revoke your license to use the affected artwork immediately;

(b) require you to immediately stop using the artwork and cease any prohibited activity;

(c) require you to delete or destroy the digital artwork and all unauthorized copies in your possession or control, except where retention is required by applicable law;

(d) suspend or terminate your access to our website or services, where applicable; and

(e) pursue any other remedies or legal claims available to us under applicable law.

Termination or revocation of a license does not affect any rights or remedies that accrued before termination. To the maximum extent permitted by law, purchases associated with a material violation of these Terms are not eligible for a refund.

8. Data, Privacy & Security

Your use of the website is governed by our Privacy Policy. Payment card data is processed exclusively by our PCI-DSS certified payment processor (Waffo Pancake) and is not stored on our servers.  

9. Disclaimers & Limitation of Liability

9.1 Disclaimer of Warranties

THE DIGITAL ARTWORKS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

9.2 Printing Variations

Our artworks are intentionally atmospheric. Final printed appearance may vary depending on the printer, inks, paper, lighting, and display conditions. We do not treat normal differences between digital previews and physical prints as product defects.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAO XUAN / STILL MOMENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

These Terms are governed by the laws of China. We may update these Terms when reasonably necessary to reflect changes to our products or applicable requirements.
